France charges Razak Baginda with graft over Scorpene deal


A CLOSE associate of Prime Minister Najib Razak has been charged in France over alleged kickbacks in the 2002 sale of submarines to Malaysia, a judicial source told AFP today.

Abdul Razak Baginda advised Najib when the prime minister was defence minister between 2000 and 2008.

Najib oversaw the deal, worth nearly €1 billion (RM5 billion), to buy two Scorpene-class submarines and one Agosta-class submarine from French naval dockyards unit DCN, which is linked to French defence group Thales.

An investigation into the deal was launched in 2010, in response to a complaint from Malaysian rights group Suaram.

As part of the deal, DCN agreed to pay €30 million to Thales' Asian unit, Thales International Asia (Thint Asia).

The investigation revealed that another company, Terasasi, whose main shareholder was Razak, received an equivalent sum for what was billed as consultancy work, but which investigators believe was really a front for kickbacks.

Razak was charged in France on July 18 with "active and passive complicity in corruption" and "misappropriation of corporate assets", the French judicial source said.

Four French defence industry executives have been charged since the investigation began.

They are two former chairmen of DCNI, Philippe Japiot and Dominique Castellan, and two former heads of Thint Asia, Bernard Baiocco and Jean-Paul Perrier.

All four men deny the charges against them.

French investigators are also looking into allegations that €114 million was paid to a purported Malaysia-based shell company, Perimekar, as part of the deal.

That company was controlled, at the time, by Razak's wife.

However, that payment is likely to ultimately fall outside the jurisdiction of the investigation because it was not made to a French company.

The affair emerged spectacularly in 2006, when Razak's Mongolian mistress, who was said to have demanded a pay-off for working as a language translator in the deal, was shot dead and her body blown up with plastic explosives near Kuala Lumpur.

A Malaysian court later cleared Razak of abetting the murder, sparking an outcry and opposition allegations of a cover-up.

Najib is currently embroiled in a money-laundering scandal involving state investor 1Malaysia Development Berhad, which he founded. – AFP, August 1, 2017.

ABDUL Razak Baginda yang pernah jadi penasihat kepada Perdana Menteri Najib Razak didakwa di Perancis berhubung kes penjualan kapal selam kepada Malaysia pada 2002, kata sumber kehakiman kepada AFP hari ini.

Razak merupakan penasihat kepada Najib semasa perdana menteri menjawat jawatan menteri pertahanan antara 2000 dan 2008.

Dalam tempoh tersebut, Najib menyelia perjanjian pembelian dua buah kapal selam Scorpene dan sebuah kapal selam jenis Agosta bernilai €1 billion (RM5 bilion) dari unit limbungan kapal DCN Perancis, yang dikaitkan dengan Kumpulan Thales, sebuah syarikat teknologi pertahanan di negara itu.

Siasatan ke atas perjanjian itu dilancarkan pada 2010, susulan aduan yang dikemukakan pertubuhan hak asasi Malaysia, Suaram.

Antara syarat perjanjian itu, DCN bersetuju membayar €30 juta kepada cawangan Thales di Asia, Thales International Asia (Thint Asia).

Siasatan kemudian mendedahkan sebuah lagi syarikat iaitu Terasasi di mana Razak merupakan pemegang saham utamanya, menerima sejumlah wang yang sama yang dibilkan sebagai bayaran perundingan. Agensi penyiasat bagaimanapun percaya wang itu sebagai sogokan.

Razak didakwa di Perancis pada 18 Julai lepas atas tuduhan “bersubahat dengan aktif dan pasif dalam rasuah” dan “penyelewengan harta korporat”, kata sumber kehakiman Perancis.

Empat eksekutif industri pertahanan Perancis setakat ini didakwa sejak siasatan tersebut bermula.Mereka ialah bekas pengerusi DCNI, Philippe Japiot dan Dominique Castellan, serta dua bekas pegawai kanan Thint Asia, Bernard Baiocco dan Jean-Paul Perrier. Kesemua mereka menafikan tuduhan.

Pasukan penyiasat di Perancis juga sedang meneliti dakwaan kononnya €114 juta dibayar kepada Perimekar Sdn Bhd sebagai sebahagian daripada urus niaga tersebut.
Syarikat tersebut pada masa itu dikawal isteri Razak.

Pembayaran komisyen itu bagaimanapun tidak tertakluk kepada bidang kuasa siasatan mahkamah di Perancis kerana tidak melibatkan syarikat republik tersebut.

Skandal pembelian kapal selam ini timbul pada 2006 selepas seorang wanita Mongolia, Altantuya Shaariibuu yang dikatakan menuntut bayaran upah sebagai penterjemah dalam urusniaga tersebut mati dibunuh dekat Kuala Lumpur.

Mahkamah Tinggi Shah Alam pada 31 Oktober 2008 membebaskan Razak tanpa dipanggil membela diri atas tuduhan bersubahat membunuh Altantuya selepas perbicaraan kes selama 151 hari. – 1 Ogos, 2017.

ABDUL Razak Baginda, yang kembali menjadi tajuk berita baru-baru ini sekali lagi menegaskan beliau tidak pernah didakwa di mahkamah Perancis.

Bekas penasihat Perdana Menteri Najib Razak itu berkata jika peguam Perancis William Bourdon mengatakan sebaliknya, tiada apa yang beliau boleh lakukan.

“Jika hari ini hari Jumaat tetapi orang nak kata hari Khamis, apa boleh kita buat?” kata Razak kepada The Malaysian Insight.

“Kita sudah mengeluarkan kenyataan mengatakan tiada siapa yang didakwa di mahkamah. Jika peguam Perancis itu mengatakan sebaliknya, itu masalah dia.”

NAJIB CAN’T AFFORD TO KEEP MALAYSIA’S CIVIL SERVANTS – OR TO LOSE THEM

With 1.6 million on the Malaysian government’s payroll, the workers are key to electoral success. But a large service keeps the country stagnant – and prone to a financial meltdown

Malaysia is stuck in the middle income trap. And one of the problems keeping it there is the massive size of its civil service – estimated at 1.6 million by Mohammad Sherif Kassim, the former secretary general of the Ministry of Finance.

While such a large service has the effect of buttressing the government, making Malaysia more stable, it also hampers efforts to transform the government, making Malaysia more stagnant too.

So while Mohammad’s desire to reduce the size of the civil service is quite understandable – indeed, it may even be necessary to prevent a government financial meltdown – Prime Minister Najib Razak knows that doing so would be the kiss of death politically, given the impending general election.

Thus Najib has taken to reassuring the civil service, which is predominantly formed of Malays, not to worry about any reduction in headcount. The can has been kicked down the road.

Najib’s take on Malaysia’s new MRT risks upsetting Chinese

It should be noted that Mohammad’s figure of 1.6 million includes armed forces, police, education and hospital personnel. The Congress of Unions of Employees in the Public and Civil Services (Cuepacs) claims that these should not be included in the headcount, as is the case in some other countries, and consequently claims the civil service numbers 500,000. Even so, there is a self-serving logic to Cuepacs’ suggestion – they don’t want their heads to roll.

However the headcount is made, the fact is the Malaysian civil service is a behemoth, one of the largest in the world.

In February 2017, the deputy finance minister, Abang Johari, warned the annual payroll was already at US$19 billion while pension payments were US$4.5 billion a year.

There is one civil servant for every 19.37 people in Malaysia, according to Johari, as opposed to 1 to 71.4 in Singapore; 1 to 110 in Indonesia; 1 to 50 in South Korea; 1 to 108 in China; 1 to 28 in Japan; 1 to 84 in Russia; and 1 to 118 in Britain.

The bloated size of Malaysia’s service causes government expenditure to rise yearly and create a government that is unwieldy and bulky.

While opposition parties like the Democratic Action Party (DAP) have voiced concern over the size of the civil service before, not even they are prepared to address the issue head on as they too are scared to lose votes. Ninety per cent of Malaysia’s civil servants are ethnic Malays.

An election like none other, is it time for change in Malaysia?

This is the demographic that the DAP and the opposition coalition have been targeting in their bid to beat Najib in the upcoming general election.

Liew Ching Tong, one of the top strategists in the DAP, believes that if the Malay votes were to dip by 15 per cent – a distinct possibility – the opposition would gain another 34 seats in parliament. This would immediately deny Najib a simple majority of 112 seats.

Given the General Election is looming – it must be called by the middle of next year – the bloated nature of the civil service has been left largely uncommented upon.

Yet, in spite of the pliant nature of the Malaysian government under Najib, there are tell tale signs that the civil service may throw their lot to the opposition anyway. These votes may well come from the armed forces and police, whose welfare and salaries remain stagnant.

Leaks against the Najib government have turned from a trickle to a torrent over the last five years.

And the Malaysian police, which has in the past appeared happy to crack down on the opposition, has begun to turn a blind eye.

Rais Hussin, the top strategist of Bersatu, which is the party of former premier Dr Mahathir Mohamad, told The Malaysian Insight that “silent support of the opposition is gaining”.

He said Malaysian civil servants were pro-Bersatu but would not declare their support openly. However, they would vote out Najib’s Umno (United Malays National Organisation) party on a secret ballot.

Can China really deliver Malaysia’s Singapore slayer?

Rais may well have a point, as the government servants fear being dismissed from their jobs.

The key question facing Najib now is fiscal management. How does he continue to pay the government employees and their pensions?

Government coffers are fast diminishing – on July 31, state investment fund 1MDB failed to make a reimbursement of US$650 million to Ipic, a sovereign wealth fund in Dubai that has lent 1MDB nearly US$6.4 billion in two loans it now wants serviced.

Najib can borrow from local banks to tide him over, but if he does this it will have the effect of “crowding out” other genuine borrowers, and the interest rate would spike.

This would lead to a vicious cycle in the economy and prompt living costs to rise.

Thus Najib is trapped. His only political lifeline is the Malaysian civil service.

If he can retain their support, and continue to attract large amounts of foreign direct investment from China, he can cling to power.

But first Malaysia must find a way around Beijing’s restrictions on how the money is spent – otherwise investments from China will cater only to Belt and Road Initiative projects.

Such a play would not be without risk, as the opposition has pointed out. If Malaysia keeps taking money from China without looking at the merits of the projects the cash is spent on, Malaysia risks becoming another Sri Lanka – which has a port managed and controlled wholly by the Chinese due to the island’s inability to repay its debt.

Why are Chinese moving to Malaysia by the thousands?

The opposition has argued, not without merit, that Malaysia under Najib stands at the precipice of just such a state of affairs if it takes a pro-China approach to the exclusion of all other investment and fiscal options provided by the international markets.

But with the albatross of 1MDB hanging on Najib’s neck – he denies being linked to a scandal at the fund in which investigators traced US$700 million into a private bank account – even the option of going global has become problematic.

Pegawai Jais didakwa salah guna kuasa


SHAH ALAM - Seorang pegawai kotrak Jabatan Agama Islam Selangor (Jais) dihadapkan ke Mahkamah Sesyen Shah Alam, hari ini atas pertuduhan penyalahgunaan kuasa membabitkan nilai RM10,000 tahun lalu.

Hairul Nizan Mhd Idris mengaku tidak bersalah di hadapan Hakim Rozilah Salleh.

Hairul Nizan, 37, sebagai Pegawai Dakwah Gred S41 didakwa telah menggunakan jawatan untuk mengemukakan permohonan dan syor bagi pembekalan oleh syarikat  Prisma Jaya Resources berjumlah RM10,000 bagi tujuan Majlis Tilawah Al- Quran peringkat Hulu Langat.

Pemilik syarikat berkenaan adalah merupakan abang kandung tertuduh.

Kesalahan itu didakwa dilakukan di Pejabat Agama Islam Hulu Langat pada 1 Februari 2016.

Timbalan Pendakwa Raya Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) Mohamed Heikal Ismail mengemukakan pertuduhan itu mengikut Seksyen 23(1) Akta SPRM 2009.

Peguam, Hamidi Mohd Noh membantah nilai jaminan RM20,000 yang dicadangkan pendakwaan atas alasan anak guamnya bergaji RM3,000.
